Welcome to the New Employment soft launch

Thank you for your interest in participating in the launch of this new service. As described in the email invitation, we have released a new online form enabling your new employees to complete their tax and super forms within ATO Online.

This online service covers the following forms:

  • Tax file number declaration (NAT 3092)
  • Withholding declaration - upward variation (NAT 3093)
  • Medicare levy variation declaration (NAT 0929)
  • Superannuation standard choice (NAT 13080)

Before we launch this new service broadly in a couple of months, we want to engage with some businesses to encourage them to use the new service and discover the benefits for themselves.

Benefits of this new service include:

  • more accurate data as the forms will be pre-filled with the employees details
  • less reverse workflow as a result of above, when you receive correspondence from the ATO to confirm a person’s identify reduces
  • less paper handling, forms completed in ATO Online do not need to be sent back to the ATO
  • more streamlined process as the service is expanded and included in your business management software.

    The Australian Taxation Office is implementing a government initiative which provides new employees a means to complete the following new employment forms online:

    The ATO has developed two different types of new employment services. Both rely on the employee using ATO online (via myGov) to complete the forms.

    New employment forms via ATO online

    The Australian Taxation Office is implementing a government initiative which provides new employees a means to complete the following new employment forms online:

    • Tax file number declaration (NAT 3092)
    • Withholding declaration - upward variation (NAT 3093)
    • Medicare levy variation declaration (NAT 0929)
    • Superannuation standard choice (NAT 13080)

    The ATO has developed two different types of new employment services. Both rely on the employee using ATO online (via myGov) to complete the forms.

    When an employee uses the ATO online new employment service via myGov to complete their TFN declaration, there will be no requirement for you to send the TFN declaration to the ATO.

    This process is intended to streamline the existing process, which often requires manual intervention by employees, employers and intermediaries to interact with government.

    It will improve data quality by simplifying questions asked of employees, and pre-filling of some individual data, therefore reducing the likelihood that incorrect information is provided.

    Employees will find it easier as a lot of their personal information will be pre-filled including:

    • name, TFN and date of birth
    • residential address
    • phone and email contact details
    • residency status
    • education loans
    • list of their current superannuation funds which can accept employer contributions
    • their employer’s default super fund

    This new service is optional and employers can continue to use their current process, such as providing their employees with paper forms or employee self-service portals.

    What are the new services?

    The ATO has developed two different types of new employment services. Both rely on the employee using ATO Online (via myGov) to complete the forms.

    Employee access directly via myGov

    Employees will log-in directly to ATO online services (via myGov) to complete the new employment form online.

    They will need to enter information, such as

    • your ABN*
    • employment status type,
    • your default fund unique superannuation identifier* (USI).

    * If an employee does not have a valid employer ABN then they will not be able to complete all forms. If the employee does not have a valid default fund USI then the employee will not be able to use the super choice form.

    The employee’s details will be validated and pre-populated (where possible) by the ATO to improve accuracy of the data provided in the on-boarding process.

    These validated employee details will then be available for printing by the employee to provide you. You don’t need to send this printed TFN declaration to the ATO.

    When your Business Management Software (BMS) is enabled, you will be able to retrieve the online forms via our secure digital channels. The forms will also be viewable by the employee in their ATO online account.

    Employer’s software linking to forms in myGov

    This services is currently being developed by digital service providers. This will allow the BMS to provide employees with a unique link to ATO online, sending and receiving data via our secure digital channels once an employee has completed the necessary forms on ATO online.

    myGov and New employment

    A new employee using this process will need to have a myGov account that is also linked to ATO Online.

    What do I need to do?

    You can:

    1. Continue to use your current process, such as providing your employees with paper forms or employee self-service portals.
    2. Ask your employee to complete their onboarding forms on ATO online via myGov. You will need to provide your employees with details needed to complete the forms.
    3. Talk to your Digital Software Provider about their plans for a BMS integrated solution.

    Information required to complete online forms

    You will need to provide your new employees with the following details to enable them to complete the online forms:

    • ABN and business name
    • employment status type (full time, part time, casual etc)
    • your default fund name and unique super identifier (USI)

    Once the forms have been completed online, employees will need to provide you with a printed summary from ATO online which will contain the necessary details to administer the employees’ tax and super.

    What happens if the employee does not complete the ATO online forms?

    If, after 28 days of the employee commencing their employment, the employee has not given a printout to you, or has not otherwise made a TFN declaration or chosen a fund you must:

    • TFN declaration:
      • notify the ATO by completing as much of the payee section of the paper TFN declaration form. Write ‘PAYER’ in the payee declaration and lodge the form.
      • withhold the top rate of tax from any payment to that employee.
    • Superannuation contributions:
      • make superannuation contributions to the default fund notified to the employee.

    NOTE: This is not a new process. This applies regardless of the method used to collect TFN and superannuation information.

    1. Your employer will need to have supplied you with details of:-
      • employer ABN
      • employment status type (full time, part time, casual etc)
      • employer’s default fund name and unique super identifier (USI)
    2. Log into myGov and authenticate yourself.
    3. Select the ATO tile.
    4. From the top menu, select Employment, then select New employment.
    5. Answer the questions on the New employment page and select whether you wish to complete the Tax details and Super details forms
    6. Click on START.
    7. Complete all the relevant screens. A lot of the answers will be pre-filled by the ATO. You are able to change the answers where applicable.
    8. SUBMIT the form.
    9. PRINT the summary.
    10. GIVE the print to your employer.

    What’s new

    You can complete your new employment forms online including:

    You’ll need to provide some details from your employer and the forms will prefill some of your details to help you get it right. This ensures your new employer withholds the correct amount of tax from you.

    What you need to do

    Obtain the following information from your employer:

    What’s new

    You can complete your new employment forms online including:

    • Tax file number declaration
    • Superannuation (super) standard choice
    • Withholding declaration
    • Medicare Levy Variation declaration.

    You’ll need to provide some details from your employer and the forms will prefill some of your details to help you get it right. This ensures your new employer withholds the correct amount of tax from you.

    What you need to do

    Obtain the following information from your employer:

    • Employers ABN
    • Employment type
    • Default super fund USI

    Once you’ve got your employers details (above):

    1. Log into myGov and authenticate yourself. If you don't have a myGov account, read How to get a myGov account.
    2. Select the ATO tile
    3. From the top menu, select Employment, then select New Employment
    4. Answer the questions on the New Employment page and select whether you wish to complete the Tax details and Super details forms.
    5. Click on START.
    6. Complete all the relevant screens. Some answers will be pre-filled. You are able to change the answers where applicable.
    7. SUBMIT the form.
    8. PRINT the summary.
    9. GIVE the print out to your employer.

    Without this information your employer may need to withhold extra tax.

    How to get a myGov account

    myGov is easy to set up.

    1. Go to my.gov.au
    2. Select Create an account at the bottom of the screen and follow the instructions. You will need an email address to create your account.
    3. Once your myGov account is set up, you can link it to ATO online services.
    4. To link to the ATO, you’ll need your tax file number (TFN) as well as a recent Notice of Assessment.
    5. If you don’t have your TFN or are having difficulties, call the ATO on 13 28 61 and press 5 for a unique linking code. You’ll need your Tax File Number and birth certificate, passport or drivers licence handy.

    You’re now ready to use ATO online services and complete your new employment forms and tax returns.
